GENERAL INFORMATION

The website https://www.crystalo.fr/ is the property of Maison CrystalÔ, whose registered office is located at 539 rue Docteur Maurer 78630 Orgeval, France (EURL with a capital of €10,000.00, RCS Versailles, Siret 848 311 478 00046 – APE 1089Z).

These general terms and conditions of sale establish the contractual conditions applicable to any purchase made on this website, as well as to all domains and trademarks registered by CrystalÔ.

Their acceptance is formalized by checking the box "I have read and accept the general terms and conditions of sale" prior to any order. By checking this box and clicking on the "Validate" button, you agree to comply with these general terms and conditions of sale, which you acknowledge having read, understood, and accepted in their entirety. If you refuse to accept these terms of use, please do not place an order.

The seller reserves the right to modify its general terms and conditions of sale at any time. The applicable general terms and conditions of sale are those in force on the date the order is placed by the customer. These General Terms and Conditions of Sale were last updated on July 31, 2024. This edition supersedes and replaces all prior versions. The contractual information is presented in French.

The essential characteristics of the products offered for sale are presented on the website. The photographs, texts, and technical data sheets are the property of CrystalÔ.

OUT OF STOCK

If an ordered product is unavailable, you will be informed via the website and/or by email as soon as possible. Moreover, if the supply time does not suit you, you have the possibility of modifying your order by contacting our customer service at +33 7 78 26 26 36.

PRODUCT PRICES

The prices listed on the https://www.crystalo.fr/ website are in Euros and include all taxes (TTC). They are subject to change at any time without notice. Shipping costs are to be added to the indicated price. These are specified in your basket at the end of your product selection and are reiterated in the order summary before validation. The prices applied are those in effect at the time of the order, within the limits of available stock, and subject to typographical errors or changes in the French VAT rate. Any change in this rate would be immediately reflected in the selling prices. All orders will be invoiced including and excluding VAT according to the CGI (French General Tax Code).

Outside the European Union or in the French overseas departments and territories, and according to the legislation in force in the delivery zone, the customer is informed that customs duties and taxes may be claimed from them by the authorities.

ORDERS

1. PROCEDURE

To validate an order, you must complete an online form, following the instructions provided, where you enter the necessary information for your identification, including your last name, first name, telephone number, postal and email addresses, and billing and delivery addresses. You then definitively validate your order by clicking on the "Validate my order" button to confirm your commitment and your acceptance of the general terms and conditions of sale. From this moment, the order is registered, and an order number is communicated to you, as well as a confirmation on the screen and/or by email. The data recorded by Maison CrystalÔ constitutes proof of the nature, content, and date of the order.

The seller reserves the right to refuse any order for legitimate reasons, particularly in the case of orders for abnormally high quantities compared to quantities usually ordered by buyers acting as consumers, in the event of a detected risk of fraud, or in the event of refusal of authorization by the bank payment centers.

2. ORDER MODIFICATION

For any modification of the order after online validation, you are invited to contact our customer service by email at: maison@crystalo.fr or by phone at +33 7 78 26 26 36 from Monday to Friday from 9:00 a.m. to 6:00 p.m.

METHOD OF PAYMENT

Payment on the site chosen by CrystalÔ can be made by credit card with the Stripe solution. Other payment solutions are offered to you, either by PayPal or by bank transfer to the CrystalÔ Banque Postale account.

The Stripe credit card payment process is carried out in several steps:

  • After filling your basket, you choose the credit card payment method. You can directly enter your credit card number, expiry date, and security code (the last three digits on the back of your card), then validate your payment.

  • Stripe Terminal is certified EMVCo Level 1 and 2 compliant with EMV® specifications for card and terminal security and interoperability. Terminal is also certified as PCI PA-DSS (Payment Application Data Security Standard) compliant, the global security standard designed to prevent third-party developed payment applications from storing prohibited sensitive data.

NIST Cybersecurity Framework

Stripe's suite of information security policies and their overall design are aligned with the NIST Cybersecurity Framework. Our security practices meet the requirements of large enterprises with requirements to provide secure products, for example, on-demand cloud computing platforms and storage (like DigitalOcean or Slack).

  • HTTPS and HSTS for Secure Connections Stripe enforces the use of HTTPS for all TLS (SSL) services, including for our public website and the Dashboard. We regularly audit the details of our deployment including the certificates we serve, the certificate authorities we use, and the ciphers we support. We utilize HSTS to ensure browsers interact with Stripe exclusively over HTTPS. Stripe is also present on the HSTS preload lists of every major browser today.

  • Card-Specific Technology Stripe encrypts sensitive data in transit and at rest. Our infrastructure for storing, decrypting, and transmitting PAN data (such as credit card numbers) operates in a segregated hosting environment and shares no credentials with the rest of our services. Our card vault is managed by a dedicated team in an Amazon Web Services (AWS) environment that is segregated from the rest of Stripe’s infrastructure. Access to this segregated environment is restricted to a small number of specially trained engineers and audited on a quarterly basis. All card numbers are encrypted at rest with AES-256. Decryption keys are stored on separate machines. As a defense in depth, we internally tokenize PANs, which are then isolated from the rest of our infrastructure. No internal Stripe servers or daemons can obtain plain-text card numbers; instead, they can request cards to be sent to a statically whitelisted set of service providers.

Our infrastructure for storing, decrypting, and transmitting card numbers operates in a segregated hosting environment and shares no credentials with core Stripe services, including our API and website. We don’t only tokenize PANs in this way; other sensitive data, like bank account details, is treated in the same manner.

  • Internal Technology Management Stripe takes a zero-trust approach to managing employee access. Employees authenticate using single sign-on, two-factor authentication (2FA) with a hardware token, and mTLS with a cryptographic certificate on Stripe-issued machines. Once on the network, further access authorization is required for sensitive internal systems and systems outside an employee's usual workflow. We monitor audit logs for anomalies, intrusions, and suspicious activity. We also monitor sensitive files in our codebase for changes. All of Stripe’s code is subject to multi-party review and automated testing. Code changes are cryptographically logged in an append-only, immutable log. We continuously collect information about Stripe-provisioned laptops to detect malicious processes, connections to fraudulent domains, and intrusion attempts. A software whitelist prevents the installation of unauthorized applications on our employees’ laptops and additions to the whitelist are subject to a rigorous process.

  • Exchanges between you and Stripe Payment are encrypted, and CRYSTALÔ does not have access to your banking data.

ORDER PROCESSING TIME

All orders are processed (validated, paid for, and prepared for shipment) the same day if placed before 3:30 p.m. on business days. For orders placed on weekends and holidays, products will be shipped the next business day. In the event of force majeure or exceptional events (natural disaster, epidemic, strike, etc.) delaying or preventing the delivery of products, CrystalÔ is released from all liability. In all cases, delivery within the time limits can only take place if you are up to date with your obligations to CrystalÔ. Any cancellation, for any reason whatsoever, and accepted by CrystalÔ, entitles you only to a refund of the sums paid. No compensation relating to this cancellation may be requested.

DELIVERY METHOD

Delivery is made to the address specified by you when placing your order. It is carried out by Colissimo, subject to the carrier's compatibility with the order. It can only take place once the order has been validated and payment has been made in full. The bank payment centers concerned will therefore have given their prior agreement to pay. In addition, we reserve the right to refuse delivery to certain public places where delivery security cannot be guaranteed. Indeed, it is impossible to guarantee hand delivery to the recipient of the package in these places. In this case, delivery may be made to the post office of your choice. We also offer delivery by Mondial Relay for all shipments within mainland France. An email and an SMS are sent when the packages are made available at the requested relay point. Upon receipt of this availability confirmation, a valid identity document of the person authorized to collect the package is required. Packages left at the relay point are available for collection for a period of 14 days, during the opening hours of the requested relay point. After this period, the packages will be returned to us, and return shipping costs may be charged to the customer who placed the corresponding order.

DELIVERY TIME

Once your order has been shipped, the delivery time varies depending on the shipping method and destination:

DELIVERY IN FRANCE:

  • 2-3 days for Colissimo shipments within mainland France

  • Approximately 4-8 days for Colissimo shipments within the EU and to Switzerland

  • Approximately 2 weeks for Colissimo shipments to French overseas departments and territories

  • 1-5 business days for Mondial Relay shipments

  • Immediately available for pick-up directly from the CrystalÔ headquarters

  • 24 hours for Chronopost France

INTERNATIONAL DELIVERY:

  • 3-7 business days with Mondial Relay Europe

  • 3-7 business days with Chronopost

  • 3-7 business days with Delivengo Easy for packages under 2 kg

  • 3-7 business days with FedEx

The indicated delivery times are given for information purposes only. They are not guaranteed in any way. Any reasonable delay in the delivery of products cannot give rise to any compensation for the benefit of the customer.

RECEIPT OF ORDER

No complaints concerning damage or problems occurring during transport will be accepted beyond 14 clear days after the date of receipt.

PENALTY CLAUSE

Sales of products made by CrystalÔ are subject to these general terms and conditions of sale, which are applied in priority to any general terms and conditions of purchase established by the customer, unless formally and expressly agreed otherwise by us.

RETENTION OF TITLE

CrystalÔ retains ownership of the goods sold until full payment of the price has been received.

WITHDRAWAL

The buyer has a period of 14 clear days from receipt of their order to return it to CrystalÔ for exchange or refund, without penalty, with the exception of shipping costs. The refund of all sums paid, including delivery costs, will be made no later than 14 days from the date on which the seller was informed of the buyer's decision to withdraw. The buyer shall only bear the direct costs of returning the products.

We may defer reimbursement until the customer has provided proof of shipment of the products. If this period normally expires on a Saturday, Sunday, or public holiday, it shall be extended to the next working day (Art. L121-16 of the French Consumer Code).

This right may be exercised using a withdrawal form (downloadable at the following address: https://www.crystalo.fr/) or any other unambiguous declaration expressing this wish.

MEDIATION

For any complaint, CrystalÔ's customer service is at the disposal of the customer. The latter can either:

The mediator can only be contacted if the following conditions are met:

  • The dispute must necessarily be related to the sale of a product purchased remotely, between a consumer and a professional.

  • The customer must have attempted to resolve the dispute with the company's Customer Service.

  • No other mediator or court must have been previously contacted to resolve the dispute.

PROTECTION OF PERSONAL DATA

CrystalÔ pays particular attention to guaranteeing the protection of its customers' personal data and to respecting French laws on the protection of privacy. In general, the information requested enables optimal processing of the order, but also the best possible management of business relations and expected services. All personal data collected from customers is intended for CrystalÔ and treated with the strictest confidentiality. This information is subject to internal IT processing for order management and the sending of documentation and offers. The information communicated by our customers is neither sold nor transferred. This is our formal guarantee.

CrystalÔ undertakes to scrupulously respect the French Data Protection Act of January 6, 1978, as amended, and the Code of Ethics of Direct Marketing Professionals. Some data is essential for processing requests or orders, others allow us to better know our customers and are used for statistical analysis purposes in order to adapt our offers to their needs. The information requested from the customer, indicated by an asterisk, is mandatory. It is necessary for the processing of the customer's requests. The other information is optional, and the customer is free not to answer it.

In accordance with Law No. 78-17 of January 6, 1978, relating to Data Processing, Files, and Freedoms, you have the right to access, rectify, or delete personal data concerning you.

LEGAL WARRANTY OF CONFORMITY

CrystalÔ is bound by the warranty against defects in conformity of the goods to the contract under the conditioans of articles L. 211-4 and following of the French Consumer Code, and by the warranty against hidden defects of the thing sold under the conditions provided for in articles 1641 and following of the French Civil Code.

When acting under the legal warranty of conformity, the customer:

  • has a period of two years from the delivery of the goods to act;

  • may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L. 211-9 of the French Consumer Code;

  • is exempt from providing proof of the lack of conformity of the goods for twenty-four months following delivery of the goods.

The legal warranty of conformity applies independently of any commercial warranty that may be granted. The customer may decide to implement the warranty against hidden defects of the thing sold within the meaning of Article 1641 of the French Civil Code. In this case, they may choose between cancellation of the sale or a reduction in the sale price in accordance with Article 1644 of the French Civil Code.

GOVERNING LAW AND JURISDICTION

These general terms and conditions of sale are subject to French law. The contractual information is presented in French, and the products offered for sale comply with French regulations. For foreign customers, it is your responsibility, where applicable, to check with the local authorities the possibilities of using the product you intend to order. CrystalÔ cannot be held liable in the event of non-compliance with the regulations of a foreign country. For any dispute or difficulty arising from the execution of an order, which could not be resolved amicably or through conventional mediation, only the Commercial Court of Versailles, or the court of the defendant's domicile, or the court of the place of delivery of the products will have jurisdiction.
